Rules of Janazah was created by Ibn Kamal
as-Salamu alaikum,

On which proofs do the Ulama of Ahl al Bayt -alayhimu-s salam- rely on the rule that the Salah al Janazah is not to be offered for the Fusaq?

Thank you for your question! As for the proofs for not performing the salaat al-janaaza over a disobedient Muslim, I cite the Sharh at-Tajreed of Imam al-Muayyad Billah (as). He says that one proof is the holy verse: {Do not pray over any of their dead ever...} (Q. 99:84). He said that the reason that this is a proof is because, although the verse was revealed concerning the disbelievers, it would equally apply to the disobedient because their eternal fate would be similar. Praying over the dead implies invoking Allah's mercy and forgiveness for the deceased. However, if the person was a faasiq who was unrepentant, such prayer for forgiveness would be inappropriate and impermissible.

As for the imam's proof from the narrated traditions, it is narrated that a woman from Juhayna committed fornication and came to the Prophet, peace and blessings be upon him and his progeny, to be stoned. She was pregnant so after the delivery and weaning, she was stoned. The Prophet performed the janaaza prayer over her. Umar responded: "Do you pray over her while she fornicated?" The Prophet, peace and blessings be upon him and his progeny, replied that she repented.

This narration proves that the janaaza is not performed over the faasiq because 1) Umar expressed surprised that the Prophet performed the prayer over her after she was shown to have fornicated and 2) the Prophet performed the prayer over her when he came to know that she repented. This shows that he wouldn't have prayed over her if she hadn't.

In another narration, the Prophet, peace and blessings be upon him and his progeny, refused to pray over a man who killed himself with an arrowhead. This report was narrated on the authority of Jaabir b. Samura. It also serves as a proof against praying over a disobedient Muslim since this person committed a major sin by killing himself.
